Terms of Service
These Terms govern your use of HuskyAi Agent CRM (the "Service") provided by HuskyAi Consulting, a Herberg LLC company ("HuskyAi," "we," "us"). By subscribing to or using the Service you agree to these Terms.
1. The Service
HuskyAi Agent CRM is a customer relationship management and marketing automation platform for insurance agents, including pipelines, workflows, calling, texting, email, forms, websites and AI assistants. Features vary by plan. We may update or improve the Service over time.
2. Accounts
You must provide accurate information and keep your login credentials secure. Each subscription covers one business. You are responsible for all activity under your account, including by team members you add.
3. Plans, billing and cancellation
- Plans are billed monthly in advance to the card on file: Agent Starter $97/month, Agent Pro $199/month. The optional Done-For-You Setup is a one-time $497 fee.
- No contracts. You may cancel at any time; cancellation takes effect at the end of the current billing period. Plan fees already paid are non-refundable, and the Done-For-You Setup fee is non-refundable once work has begun.
- We may change plan prices with at least 30 days' notice.
- Failed payments may result in suspension of the account until the balance is paid.
4. Usage charges
Plan fees cover access to the software only. Calls, text messages, emails, AI usage, phone numbers and carrier registration fees are not included and are billed separately based on actual usage, monthly, to the card on file. Current rates:

AI voice calls use both voice minutes and AI credits. Usage rates may change with 30 days' notice. You are responsible for all usage your account generates, including from automated workflows and AI agents you turn on. Unused usage does not roll over and is non-refundable.
5. Your compliance responsibilities
You are solely responsible for how you use the Service to contact people. You agree to:
- Comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, CAN-SPAM, state telemarketing and call-recording laws, and wireless carrier and CTIA messaging rules.
- Only call, text or email people who have given the consent required by law, honor opt-outs promptly, and check numbers against Do-Not-Call lists where required.
- Disclose call recording and AI-voice use where required, including in all-party-consent states.
- Comply with insurance licensing, advertising and marketing rules in every state where you solicit business.
- Complete A2P 10DLC or toll-free registration before sending texts, and provide accurate information for it.
6. Acceptable use
You may not use the Service to send spam, unlawful or deceptive content, phishing, or content prohibited by carriers (including loan or debt solicitation, cannabis, or gambling messaging); to infringe others' rights; to interfere with the Service; or to resell the Service without our written permission. We may suspend accounts that violate these Terms or put the platform's messaging reputation at risk.
7. AI features
AI assistants generate responses automatically and can make mistakes. You are responsible for reviewing their configuration, scripts and output, and for ensuring they do not quote premiums, make guarantees, or give advice you are not permitted to give. AI does not replace your licensed judgment.
8. Your data
You own the data you upload or collect through the Service. You grant us permission to host and process it to provide the Service. Our Privacy Policy describes how we handle personal information. You may export your data before cancelling; we may delete it after a reasonable period following cancellation.
9. Delivery and availability
Carriers may block or filter messages and calls, and delivery is not guaranteed. The Service relies on third-party providers and may experience interruptions. We do not guarantee uninterrupted or error-free operation.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any number of leads, appointments, sales or results.
11. Limitation of liability
To the fullest extent permitted by law, HuskyAi will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.
12. Indemnification
You agree to defend and indemnify HuskyAi against claims, fines and costs arising from your use of the Service, your content, or your violation of these Terms or any law, including TCPA and telemarketing claims.
13. Changes and termination
We may update these Terms; continued use after changes take effect means you accept them. We may suspend or terminate accounts for non-payment or violation of these Terms.
14. Governing law
These Terms are governed by the laws of the State of Washington. Disputes will be resolved in the state or federal courts located in Yakima County, Washington.
